Mesothelioma compensation: trusts, settlements, VA benefits

If you or someone you love has mesothelioma, compensation can come from three places: asbestos trust funds, a lawsuit against the companies responsible, and, for veterans, the VA. Plenty of people qualify through more than one channel, and a trust claim does not cut into a lawsuit. The strict limit is the court filing window: states allow anywhere from one to six years following a diagnosis, and a missed deadline can shut off compensation. That makes your deadline the first thing to check. Call today, and one call to our claims team checks whether your state's lawsuit deadline is still open and which asbestos trusts fit your work history.

How much does each path pay?

Each path pays differently and moves at its own pace, so a side-by-side view helps.

PathTypical payoutWhen money starts
Claims across every asbestos trust$300,000 to $400,000Roughly 90 days once filed
Settling the lawsuit$1 million to $2 millionRoughly 6 to 12 months
Winning at trial$5 million to $11.4 millionPaid only after a trial win

Once settlement money and trust payments are combined, the average total is over $1 million. The amount in your case turns on the claim type and the medical details, and you may use the money however you choose.

Settlement or trial: which is better?

With a settlement, the companies agree to pay and the case never reaches a courtroom, and almost every mesothelioma case resolves this way. A single case can include every company responsible, often 60 or more.

Jury awards run higher, $5 million to $11.4 million on average, but fewer than 5% of cases ever reach a jury. Your state's deadline decides whether you can still sue, and the same call that checks your trusts tells you if that window is still open.

What does each company's trust pay?

Starting in the late 1980s, many asbestos companies went bankrupt after facing thousands of lawsuits, and federal law required them to set up trusts to pay current and future victims. More than 60 companies created them, and the trusts now hold over $30 billion.

Each trust sets its own payment amount for an approved mesothelioma claim. The share it pays can run from 0.7% up to the full 100%, varying by trust, so the same illness can bring very different checks.

TrustPays today on an approved claim
W.R. Grace$54,180
Flintkote$27,600
Johns-Manville$19,600
Owens Corning / Fibreboard$9,245
Federal-Mogul$5,800

Many people can get payments from more than one trust. On one call, the claims team of the sponsoring law firm checks every trust that fits your work history, then prepares and files the trust claims for you.

VA help for veterans

Because the VA rates this illness as fully disabling, veterans who were exposed while serving may qualify for a 100% rating, monthly compensation, and VA health care. For 2026, a veteran rated 100% gets $3,938.58 a month on their own, $4,158.17 with a spouse, and $4,318.99 with a spouse and one child.

Once your claim is approved, the first payment arrives in about 81 days. It's tax-free, it rises each year with Social Security's cost-of-living increase, and it doesn't stop you from filing trust claims or a lawsuit as well.

Common questions

How long does a settlement take?

It varies based on the kind of claim, the filing deadline in your state, and the number of companies involved. Eligible patients can also get Social Security disability approved faster through Compassionate Allowances while the claim moves forward.

Can family members file after a death?

Yes. A husband, wife, partner, or close relative may bring a wrongful death claim, meaning a lawsuit filed for someone who has died; state law controls who can file. Veterans' families may be eligible for Dependency and Indemnity Compensation paid monthly, plus burial benefits. People who got sick from fibers a family member brought home from an at-risk job may also qualify.

Can a calculator estimate my compensation?

Not reliably. The amount depends on the kind of claim you bring and the details of your diagnosis. One call to the claims team checks every asbestos trust that fits your work history and whether your state's lawsuit deadline is still open.
